CONVICTED CHILD-KILLER PLEADS GUILTY AND ADMITS
CONCEALING A DANGEROUS WEAPON IN HIS RIKERS ISLAND JAIL CELL

Bronx District Attorney Robert T. Johnson announced today that Cesar Rodriguez, 29, pled guilty to a single count of Promoting Prison Contraband in the 1st degree, a crime that occurred while the defendant was confined at the City jail on Rikers Island awaiting trial in Brooklyn in the death of Nixmary Brown.

Rodriguez admitted that he was in possession of “dangerous contraband” ,a sharp jagged piece of metal that was hidden in his cell at the Robert N. Davoren Complex, a detention facility at the City jail on Rikers Island. The crime occurred on March 21, 2007 while Rodriguez was being detained for trial in the death of 7-year-old Nixmary Brown. Earlier this year, a jury in Brooklyn convicted Rodriguez of manslaughter, criminal possession of a weapon, and other offenses in the brutal and deadly beating of his stepdaughter. Rodriguez is currently serving a maximum sentence of up to 29 years in prison for those crimes.

State Supreme Court Justice Steven Barrett set sentencing on today’s conviction for Thursday, May 15, 2008 in Part 60. Under terms of the plea agreement, Rodriguez will receive a term of 1 to 3 years imprisonment to run concurrently with the 29 year sentence that he is already serving.
